Legislative Update

As we come to the final hours of another legislative session, Housing remained a top area of focus for the 2025 session. Lawmakers held very little back, introducing over 30 bills primarily focused on growing regulations of the rental housing industry. Bills that would regulate software used to set rents and give the state attorney general more power in investigating rental housing providers have the potential to drive up costs for providers and, consequently, make housing less attainable for renters in Colorado.

SB 25-020
Tenant and Landlord Law Enforcement
The bill grants the Colorado Attorney General, counties, cities and municipalities with the power to initiate and bring civil and criminal actions to enforce laws involving rental housing providers and tenants.

HB 25-1004
No Pricing Coordination Between Landlords
The bill prohibits rental housing providers from subscribing to or contracting with a pricing coordinator, a coordinator from facilitating an agreement among housing providers that restricts competition and two or more housing providers from engaging in parallel pricing coordination.

Landowner Immunity for Emergency Access to Property
The bill provides immunity from civil liability for damage or injury to persons or property, other than that which arises from gross negligence or willful misconduct, to a landowner who allows access to the landowner's property for entry and exit in connection with an emergency.

HB 25-1090
Protections Against Deceptive Pricing Practices
The bill prohibits offering, displaying or advertising pricing information for any good, service or property without disclosing the maximum total price of all amounts that a person may pay. Housing providers specifically would be prohibited from requiring tenants to pay certain fees, charges or amounts.

Jury Trials for Tenant Proceedings

The bill affords the right to a trial by jury to decide all issues of fact in eviction cases.
